This website (‘Site’) is operated by Telehealth Clinics Australia Pty Ltd, ABN 80 646 800 526 (we, our, us or ‘Quitwise’). It is available at: quitwise.com.au and may be available through other addresses or channels. These Terms of Use (‘Terms’) govern your access to and use of our website, whether you’re a visitor browsing listings or content, or a pharmacy representative claiming a listing. By accessing or using our site, you agree to these Terms.

1. About Quitwise

Quitwise serves consumers by offering a pharmacy directory and educational vaping, smoking, and quitting related information modules and articles (‘Content’). ‘You’ refers to all users, including casual visitors and registered pharmacy representatives.

2. Changes to Terms

We may update these Terms at our discretion. Changes take effect when posted on this page. If you have a registered account, we will endeavor to notify you of significant changes via email using the address you provided.

3. Accounts and listing claims

Eligibility: Only authorized representatives of a pharmacy may claim a listing. You must provide accurate details (name, email, phone, password) to verify your ownership or authority.
Account Security: You are responsible for keeping your account credentials confidential and secure. Notify us immediately at support@quitwise.com.au if you suspect unauthorized access.
Accuracy: You must ensure all information you submit (e.g., listing details) is accurate and up-to-date. We may request additional proof of ownership (e.g., business registration) to approve a claim.
Privacy: We handle your personal information according to our Privacy Policy.

4. Site content

All content on Quitwise—including, but not limited to, pharmacy listings, Content, and visual elements (except user-submitted content)—is owned by us or our licensors. You may not reproduce, modify, or distribute it without our written consent, except for personal, non-commercial use as permitted by law.

Our Content is informational only and not a substitute for professional advice (e.g., medical, legal, pharmaceutical, or otherwise).

5. User content

When you submit content (e.g., listing updates or corrections), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and modify it solely for the purpose of operating and improving the directory.

You confirm that your content is accurate, lawful, and does not infringe on any third-party rights.

We do not currently allow comments or submissions on our Content, but if this changes, additional rules may apply.

6. Prohibited conduct

You must not:

Use the site for any illegal purpose or impersonate another person or entity.
Attempt to claim a listing you are not authorized to manage.
Interfere with the site’s operation (e.g., through hacking, viruses, or unauthorized scraping).

To the fullest extent permitted by law, we disclaim all warranties, express or implied, except those that cannot be excluded under the Australian Consumer Law (ACL).

9. Limitation of Liability

We are not liable for indirect, consequential, or incidental damages (e.g., loss of profits or harm from relying on our Site or Content).

Nothing in these Terms excludes or limits your statutory rights under the ACL if you are a consumer.
